1. Nature of Booking Requests (Non-Binding Inquiry) All booking actions made through Jolidi.ch or our booking software provider Lodgify constitute a non-binding booking request (“Buchungsanfrage”). A binding rental contract is only formed once the guest receives an explicit written booking confirmation from Jolidi.ch. Until such confirmation is issued, Jolidi.ch reserves the right to decline or cancel any request without contractual obligation, even if an automated payment authorization has been triggered. 2. Automatic Payments and Refunds In certain cases, the Lodgify system may process payment information before availability is fully verified. If Jolidi.ch declines a booking request due to unavailability or other reasons: The request is cancelled immediately, and Any payment already processed is fully refunded without delay. No contractual rights or obligations arise from such requests. 3. Availability & System Errors Jolidi.ch aims to maintain accurate availability data. However, in rare cases, system delays, owner-side changes, or technical errors may occur. If availability cannot be confirmed, Jolidi.ch may cancel the request without liability, and the guest will be refunded fully if any payment was taken. 4. No Liability for Alternative Accommodation Jolidi.ch is not liable for: Higher prices of alternative accommodations Costs incurred by independently made bookings Loss of opportunity, travel changes, or consequential damages This applies particularly when a booking request has been declined or cancelled before a binding contract is formed, or when the guest does not contact us for assistance with alternatives. Guests who book replacement accommodations on their own do so at their own risk and cannot claim reimbursement for differences in price or additional expenses. 5. Guest Duty to Contact in Case of Issues If a requested accommodation becomes unavailable, guests are expected to contact Jolidi.ch directly. Jolidi.ch will make reasonable efforts to assist in finding alternative options. Failure to contact Jolidi.ch before independently booking alternative accommodation excludes any potential liability for compensation. 6. Contractual Basis All rental agreements concluded via Jolidi.ch are governed by Swiss law, in particular Art. 1 ff. OR on the formation of contracts. Only written booking confirmations issued by Jolidi.ch create a binding agreement.
